Beak is a product of Zukisan Labs LLC. References to "Beak," "we," "our," and "us" in these Terms refer to Zukisan Labs LLC.
By creating a Beak account or using the Beak application, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service.
You must be at least 18 years old to use Beak. By creating an account or using Beak, you represent and warrant that you are at least 18 years old and have the legal capacity to agree to these Terms. If you do not meet this requirement, you may not use the service.
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when creating your account, including a valid phone number, which we use for account verification, friend discovery, and related platform features.
You may not create accounts for others without their authorization, impersonate any person or entity, or provide false information to obtain access to Beak.
Beak is a social availability platform that allows users to share their current availability and interests with friends. You agree to use Beak only for lawful purposes and in accordance with these Terms.
You agree not to use Beak to:
We may remove content, restrict visibility, suspend accounts, or take other action if we believe content or behavior violates these Terms, creates risk, or harms other users or the service.
Beak is a social availability app. It is not an emergency communication service. Do not use Beak to contact emergency services, request urgent help, or determine whether someone is safe. Availability, status, and location information on Beak may be delayed, inaccurate, unavailable, or intentionally limited by user privacy settings.
If you or someone else is in danger, call your local emergency services immediately.
Do not rely on Beak to establish, confirm, or monitor anyone's physical safety or whereabouts.
You retain ownership of content you post on Beak. By posting content, you grant Beak a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, distribute, and technically process that content only as needed to operate, maintain, secure, and improve Beak, and to make the content available to the users you have chosen to share it with, in accordance with your privacy settings.
You are solely responsible for the content you post. We do not endorse user content and do not assume any liability for it.
Your use of Beak is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Beak collects and uses your phone number for account verification, security, friend discovery, and related platform features. We do not sell your personal information.
When you choose to attach a location to a beacon, your device sends GPS coordinates to our servers. Before any location is stored or shared with other users, we apply a randomized offset of approximately 5 miles (8 km) to produce an approximate location. We do not intentionally store or display your original precise coordinates. Location sharing is always optional. See our Privacy Policy for full details.
Beak, Zukisan Labs, our logos, software, designs, and related materials are owned by Zukisan Labs LLC or its licensors. These Terms do not grant you any ownership rights in Beak. You may not use our name, logo, or branding without our prior written consent.
Some features of Beak may require payment or a subscription. Purchases made through the Apple App Store or Google Play are processed by those platforms and are subject to their respective payment terms. Beak does not control platform billing, refunds, or cancellation policies except where required by applicable law.
Subscriptions may automatically renew unless canceled through the applicable app store before the end of the current billing period. Deleting your Beak account or removing the app from your device does not automatically cancel an app store subscription.
Beak relies on third-party service providers, including Firebase and Google (authentication, real-time data, push notifications, and analytics), PostHog (product analytics), AWS (SMS verification), and hosting and infrastructure providers. These providers may process information as needed to provide, secure, maintain, and improve the services they provide to us. Your use of app stores, device platforms, and related platform services is also subject to their own terms and privacy policies. We are not responsible for the practices of third-party providers.
If you submit ideas, suggestions, or other feedback to us about Beak, you grant us the right to use that feedback for any purpose without obligation or compensation to you.
We may suspend or terminate your account if you violate these Terms or if we determine that your use of the service creates risk or harm. You may delete your account at any time from within the app.
When you delete your account, we will delete or de-identify your personal information as described in our Privacy Policy, except where we are required or permitted to retain information for legal, security, fraud prevention, backup, or legitimate business purposes.
Beak is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We do not guarantee that beacon status, availability, audience settings, notifications, or approximate location information will be accurate, current, complete, or available at any particular time.
To the maximum extent permitted by applicable law, Zukisan Labs LLC, its owners, officers, employees, contractors, service providers, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
Zukisan Labs LLC, not Apple, is solely responsible for Beak and its content. Apple has no obligation to furnish maintenance or support services for Beak. Zukisan Labs LLC, not Apple, is responsible for addressing any claims relating to Beak, including product liability claims, claims that Beak fails to conform to any applicable legal or regulatory requirement, and consumer protection claims. You and Zukisan Labs LLC acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and that, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
We may update these Terms from time to time. When we do, we will notify you through the app and require your acceptance before you can continue using Beak.
These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law principles.
